Court says pot smokers can be fired, even in Colorado DENVER — Medical and recreational marijuana may be legal in Colorado, but employers in the state can lawfully fire workers who test positive for the drug, even if it was used off duty, according to a court ruling Thursday. The Colorado Court of Appeals found there is no employment protection for medical marijuana users in the state since the drug remains barred by the federal government. “For an activity to be lawful in Colorado, it must be permitted by, and not contrary to, both state and federal law,” the appeals court stated in its 2-1 conclusion. The ruling concurs with court decisions in similar cases elsewhere and comes as businesses attempt to regulate pot use among employees in states where the drug is legal. Colorado and Washington state law both provide for recreational marijuana use. Several other states have legalized medical use. Police departments have been especially concerned since officers are sworn to uphold both state and federal laws. Read more: times free pressLegalization ain't all it's cooked toked up to be.

Say they legalize the personal use of marijuana in Tennessee? Say I am a cop, fireman, ER nurse/doctor, or teacher, and I lawfully decide that since it is legal, and all, I can twist one up when off duty?
Do you support the cop's, fireman's, ER nurse's/doctor's or teacher's new 'right' to do so, as long as they are off-duty?
What say you?

You say that as though it doesn’t already happen.
I have no proof one way or the other. Just sayin’.

And company policies will be changing quickly when they find out it's their best employess, not their worst, that are testing positive. By the way, not even for current intoxication, but for evidence of something they did on their own time.

Not only do I support it, I encourage it, Most them types are wound to tight anyway. This would cut down on taxpayer funded lawsuits from police brutality. Plus we all know they're getting high anyway when off work. Be it some OG KUSH, Wild Turkey, Xanax,Hydro's, etc..party on garth..

I support the legalization of marijuana. Not decriminalization, legalization.
I support an employer's right to employee only the people they deem fit to employee.

I also support my right to choose to do business with whomever I choose to do business with based on my own criteria which does include their employment practices.

Sooner or later the law and science will catch up. The law will find a way to make money off pot as they currently do from alcohol. Then the science will figure out a way to distinguish active intoxication vs. previous use, just as they do with alcohol right now. Then we can really go to work on those nogoodniks who won't give up their <ahem> "poppyseed rolls."

Unfortunately, our collective 'law', 'science' and 'religion' (Or professed lack thereof) are constantly catching up, and passing, each other and have done so since our simple failing human concept of time began, in the first damn place.
When all these seemingly conflicting world views, laws, religions, science, opinions or facts are truly equal in force (Yet still opposite in momentum, truth, direction and velocity) and curiously traveling at the same velocity, in the same direction, at the same time, truthfully?
It's the Biblical, Scientific and Lawful conjunction of Armageddon, anyway.
And then? None of it will really matter to the remaining rest of us, in the great scheme of things! ;D
(I just wanna work that crash......... before I pass on!)
