Yet Marijuana remains a Schedule 1 narcotic. Unbelievable. Yeah, Sport, political reality's gonna make it kinda tough to change that while our neighbor to the South is fighting a WAR in which the families of the DEAD are being slaughtered over this crap.

Smoke all you want---just not where I can smell it. Your right to smoke does NOT trump my right to clear air. The question of "Rights" has surfaced here. Since Obama has not re-written the Constitution, yet, and if I remember rightly every one has the " Freedom of Choice" and the Right to " Life, Liberty and the Pursuit of Happiness". If it makes me "happy" to have a smoke and I "choose" to do so, then it is my Constitutional Right. However it is your "choice", if you see me smoking to not get within smoking range. I'm not talking about smoking in confined spaces, the laws have already addressed that problem. But if I am standing outside in the rain, snow, sweltering heat or freezing cold to have a smoke it would be very detrimental to someone's health to walk over to me and start bitching. When it comes to clean air we are all guilty. We run around in our gas guzzlers that dump more toxins in the air in a few hours than a lifetime of smoking would. So if you want cleaner air, ride a bicycle, which I do every chance I get, even to the store to pick up a pack of smokes. ;D

If we're on public property, then I have just as much of a right to smoke as you do to not smoke.
If we're on private property, then the property owners gives whom what rights. If he says no smoking on the side walk, then that's his right to not let me smoke on the side walk near you.
Otherwise, we're all equal, and all of your rights are just as important as mine.

I got no dog in this hunt as I am a 16 month reformed smoker. However my thoughts on this and most other things are that unless I am attempting to derive you of life, liberty, or property it's none of your damn business what I do. Oh and Dutch, the constitution does not mention anything about the pursuit of happiness. That little gem is actually in the Declaration of Indepedence.
