A certified massage therapist from Montgomery County will be allowed to practice on horses again.
Mercedes Clemens filed a lawsuit against the Maryland Board of Chiropractic and Massage Therapy Examiners last summer after the agency sent her a letter directing her to stop massaging animals, or face losing her massage license.
Circuit Court Judge David Boynton ruled Thursday that the agency lacked the authority to issue the order in this case. He says the board can regulate human massage licenses, but there's no license required for animal massage in Maryland.
Attorneys from the Institute for Justice, a libertarian public interest law firm that represented Clemens, called the ruling a victory.
Grant Gerber, the board's attorney, says the agency will abide by the decision.
